En el artículo se presentan las novedades jurisprudenciales del Tribunal Supremo en la aplicación de la perspectiva de género. Con especial atención en el ámbito penal, el texto recorre la valoración de la declaración de la víctima en el juicio oral y la viabilidad de la prueba pericial en relación a la veracidad sobre la declaración de la víctima en materia de violencia de género.

We argue against the claim that the employment of diagrams in Euclidean geometry gives rise to gaps in the proofs. First, we argue that it is a mistake to evaluate its merits through the lenses of Hilbert’s formal reconstruction. Second, we elucidate the abilities employed in diagram-based inferences in the Elements and show that diagrams are mathematically reputable tools. Finally, we complement our analysis with a review of recent experimental results purporting to show that, not only is the Euclidean diagram-based (...) practice strictly regimented, it is rooted in cognitive abilities that are universally shared. There is an ongoing debate about the meaning of lexical words, i.e., words that contribute with content to the meaning of sentences. This debate has coincided with a renewal in the study of polysemy, which has taken place in the psycholinguistics camp mainly. There is already a fruitful interbreeding between two lines of research: the theoretical study of lexical word meaning, on the one hand, and the models of polysemy psycholinguists present, on the other. In this paper I aim at (...) deepening on this ongoing interbreeding, examine what is said about polysemy, particularly in the psycholinguistics literature, and then show how what we seem to know about the representation and storage of polysemous senses affects the models that we have about lexical word meaning. Geographical and geospatial ontologies are receiving a considerable attention in information technology, due to three different factors: the growing diffusion of Geographic Information Systems (GIS), their use in different applications and the impulse given by Semantic Web to this research area. The aim of these pages is to describe what a geo-information ontology is, in order to systematize the contemporary debate. In the first part, we delineate the domain of ontology of geography within the contemporary philosophical context. Following some of the main arguments Derrida develops in ‘White Mythology’, in this article I propose an unexplored dialogue between Derrida and Althusser considering the use and the place that each of them gives to metaphor in their philosophical strategies. I give special attention to some rather isolated passages of ‘Elements of Self-Criticism’ and ‘Lenin and Philosophy’, where Althusser, against all evidence, seems to be quite aware of the importance of metaphor and mataphorization in every philosophical practice. As Balibar has (...) argued, contrary to the metaphysical tradition, metaphor would not be the opposite but what anticipates the concept. In this sense, it is possible to observe how Althusser’s work has continuously put into practice – as the singular signature of his theoretical practice – something that I call the ‘detour of metaphor’ as a necessary ‘deviation’ for the production of new concepts. Without any evidence that Althusser may have known Derrida’s essay, I show how Althusser’s own theoretical work, one in which ‘metaphor’ as a philosophical theme appears to be rather anecdotic, is unexpectedly close to Derrida’s own positions concerning the margins of philosophy and its ‘outside’, the relation to the metaphysical tradition, and the importance of strategy in philosophy. Faced with both interpretations, it would be our intention, first of all, to explain the relevance of the montanian skepticism, its importance in the work of the author, and second exposing traditional and innovative positions, make clear their limits. This try to conclude the “truly” skeptical nature the of montanian skepticism, innovative and traditional at the same time. In addition, it attempts to resist the classification of dogmatic theories, traditional or renewal, which would seek to impose their own systems rather than read the author in his own terms. Teaching mathematics and improving mathematics competence are pending subjects within our educational system. The PEIM (Programa Evolutivo Instruccional para Matemáticas), a constructivist intervention program for the improvement of mathematical performance, affects the different agents involved in math learning, guaranteeing a significant improvement in students’ performance. The program is based on the following pillars: (a) students become the main agents of their learning by constructing their own knowledge; (b) the teacher must be the guide to facilitate and guarantee such a construction (...) by being a great connoisseur of the fundamental aspects of the development of the child’s mathematical thinking; (c) the mathematical contents must be sequenced in terms of the complexity and significance for the student as well as contextualized at all times; and (d) the classroom must have a constructivist climate highlighting cooperative work among students. The implementation of PEIM along with the empirical evaluation conducted in several centers in Madrid and Zaragoza (Spain) confirm how students improve their mathematical competence. Both first- and second-grade students in elementary education were far more effective in solving problems, highlighting the use of more advanced strategies in their resolution and a lower incidence of conceptual errors. Moreover, it was possible to verify how the students proving greater difficulty, experienced an evolution in learning similarly to those who did not present it. The program provides customized education to allow the teacher to know at all times how he should be more influential on the students’ learning through mathematical profiles. Both teaching practice and teachers were observed, being that of the experimental group more prone to analyzing processes and allowing the construction of knowledge by students, due to their psycho-developmental training. As a result, we found several improvements through the implementation of the program that may serve, for upcoming years, as a basis for the necessary changes in the teaching of mathematics. (shrink)

In this paper we introduce two issues relevantly related to the cognitive phenomenology debate, which, to our minds, have not been yet properly addressed: the relation between access and phenomenal consciousness in cognition and the relation between conscious thought and inner speech. In the first case, we ask for an explanation of how we have access to thought contents, and in the second case, an explanation of why is inner speech so pervasive in our conscious thinking. We discuss the prospects (...) of explanation for both sides of the debate and argue that cognitive phenomenology defenders are in an overall advantageous position. This paper presents a blueprint for an ecological cognitive architecture. Ecological psychology, I contend, must be complemented with a story about the role of the CNS in perception, action, and cognition. To arrive at such a story while staying true to the tenets of ecological psychology, it will be necessary to flesh out the central metaphor according to which the animal perceives its environment by ‘resonating’ to information in energy patterns: what is needed is a theory of resonance. A fundamental tension exists between Rawls's ideal Kantian conception of justice as fairness (JAF), which requires respecting people as ends, and his realistic non-Kantian consequentialist conception of a supreme emergency in a just war. By justifying the targeting of objectively innocent noncombatants during a supreme emergency exception, Rawls allows for treating them as means only. Hence, his appeal to a supreme emergency is insufficient to avoid this tension. First, since for him JAF is ideal but also practical, one might argue (...) that his fictional people in the original position must reflect on the justification for using force on behalf of JAF. And second, since Rawls justifies targeting objectively innocent people during a supreme emergency exemption, he justifies what one might conceive of as emergency terrorism. Emergency terrorism, however, treats people as means only. Therefore, Rawls's Kantian conception of JAF is in tension with his consequentialist justification of a supreme emergency in a just war and hence with emergency terrorism. (shrink)

One big challenge faced by cognitive science is the development of a unified theory that integrates disparate scales of analysis of cognitive phenomena. In this paper, I offer a unified framework that provides a way to integrate neural and behavioral scales of analysis of cognitive phenomena—typically addressed by neuroscience and experimental psychology, respectively. The framework is based on the concept of resonance originated in ecological psychology and aims to be the foundation for a unified theory for radical embodiment; that is, (...) a unified theory for that dissident part of cognitive science that shares a methodological commitment to dynamic systems theory and remains skeptical about the adequacy of mechanism and representationalism as the guiding ideas in the field. Much of what we say is never said aloud. It occurs only silently, as inner speech. We chastise, congratulate, joke and cajole, all without making a sound. This distinctively human ability to create public language in the privacy of our own minds is no less remarkable for its familiarity. And yet, until recently, inner speech remained at the periphery of philosophical and psychological theorizing. This essay collection, from an interdisciplinary group of leading philosophers, psychologists, and neuroscientists, displays the rapidly growing (...) interest among researchers in the puzzles surrounding the nature and cognitive role of the inner voice. Questions explored include: the aids and obstacles inner speech presents to self-knowledge; the complex relation it bears to overt speech production and perception; the means by which inner speech can be identified and empirically assessed; its role in generating auditory verbal hallucinations; and its relationship to conceptual thought itself. We advance a theory of the representational role of Euclidean diagrams according to which they are samples of co-exact features. We contrast our theory with two other conceptions, the instantial conception and Macbeth’s iconic view, with respect to how well they accommodate three fundamental constraints on theories of the Euclidean diagrammatic practice— that Euclidean diagrams are used in proofs whose results are wholly general, that Euclidean diagrams indicate the co-exact features that the geometer is allowed to infer from them and (...) that Euclidean diagrams play the same role in both direct proofs and indirect proofs by reductio—and argue that our view is the one best suited to account for them. We conclude by illustrating the virtues of our conception of Euclidean diagrams as samples by means of an analysis of Saccheri’s quadrilateral. (shrink)

As teorias historicistas da racionalidade científica são produtos relativamente recentes da filosofia da ciência. Adequando-se aos dados extraídos da história da ciência, elas diferem de abordagens mais abstratas ou normativas da atividade científica que predominaram na primeira metade do século vinte. As teorias historicistas, contudo, são desafiadas pela dificuldade de conciliar a adequação empírica à história da ciência com a atribuição de racionalidade aos cientistas eles mesmos, especialmente quando escolhem entre hipóteses científicas rivais. Este artigo discute três influentes teorias historicistas (...) da racionalidade científica, devidas a Kuhn, Lakatos e Laudan, analisando como cada uma trata da racionalidade dessas escolhas, e argumenta em favor de análises de tipo kuhniana, que exploram o papel dos valores nas escolhas científicas e não as concebem como guiadas exclusivamente por regras de aplicação unívoca ou universal. O projeto emancipatório moderno estabelece uma concepção otimista de desenvolvimento científico e social. Os filósofos Immanuel Kant e Karl Marx, de modo distinto, levam ao ápice tal projeto emancipatório, o primeiro, ancorado numa concepção de sujeito transcendental capaz de estabelecer verdade e validade universal, o segundo, ancorado na categoria de trabalho desenvolvida em sua doutrina do materialismo histórico. A partir do século XIX, filósofos como Nietzsche, Heidegger e Adorno/Horkheimer põem sob suspeita tal projeto ao demonstrar seus fundamentos não metafísicos. Tais (...) críticas expurgam as pretensões totalitárias do projeto emancipatório moderno, e nos remetem à sua revisão. O filósofo alemão Jurgen Habermas, considerando as críticas elaboradas pelos filósofos da suspeita, vai buscar reconstruir o projeto emancipatório moderno a partir de bases pós-metafísicas. A raiz de tal reconstrução está em Trabalho e Interação. Notas sobre a filosofia do espírito de Hegel em Jena, na qual Habermas promove o confronto da filosofia hegeliana com o pensamento de Kant e Marx, possibilitando a revisão destes. Nessa revisão Habermas desenvolve os conceitos de trabalho e interação, que ao mesmo tempo fundamentam sua crítica à tecnocracia e lançam os pilares para a posterior elaboração da Teoria da Ação Comunicativa. Quand l’analyse de corpus réfute des idées reçues : le cas de l’interpolation dans des dialectes du portugais européenCet article analyse l’interpolation (c’est-à-dire la possibilité d’occurrence d’un proclitique séparé du verbe) comme un trait des dialectes du portugais européen (PE) contemporain, tel qu’il est montré par les données fournies par le Syntax-oriented Corpus of Portuguese Dialects – CORDIAL-SIN. Les objectifs de cet étude sont les suivants : (i) décrire les propriétés des constructions d’interpolation dans les dialectes contemporains du PE ; (...) (ii) comprendre la corrélation entre l’interpolation et les propriétés d’autres constructions avec clitiques dans les mêmes dialectes ; (iii) fournir une perspective diachronique sur l’interpolation non-standard en tenant compte de l’histoire générale de l’interpolation. La recherche sur ce thème, dont les résultats sont présentés en détail dans Magro (2007), montre que, dans beaucoup de dialectes contemporains du PE, l’interpolation actuelle est une construction très productive qui possède des traits particuliers, qui la différencient de l’interpolation du PE ancien. Cette étude montre que, contrairement à ce qu’on croit d’habitude, l’interpolation n’est pas un trait archaïque mais plutôt une innovation récente dans la grammaire du PE. L’analyse présentée adopte la structure de la grammaire définie dans le cadre de la Morphologie Distribuée (Distributed Morphology, Halle & Marantz 1993, 1994), en considérant l’interpolation comme une instance d’une opération de déplacement post-syntaxique qui a lieu au stade final d’une dérivation. El artículo aborda el comportamiento de los precios, salarios y deuda morosa de las familias como una aproximación a la comprensión de las causas de la movilización social en Chile desde 2019. Si bien este país ha mostrado sólidos fundamentos macroeconómicos durante los últimos treinta años, estos han escondido importantes cuellos de botella para las familias como alzas de precios de bienes y servicios sensibles para la población, salarios estancados, una de las distribuciones del ingreso más desiguales del mundo, un (...) mercado laboral heterogéneo y el crecimiento galopante de la deuda morosa de los mayores de dieciocho años. Se plantea que estas insatisfacciones económicas han puesto en apuro a las familias chilenas, especialmente a las más vulnerables y la clase media, las que exigen cambiar el modelo de desarrollo. En este contexto, la presente investigación trata de ofrecer una aproximación informativa y ajustada al conjunto de la obra de Benjamin, en una lectura efectuada desde el punto de vista de la Estética. In this paper we discuss a phenomenon we call perspectival plurality, which has gone largely unnoticed in the current debate between relativism and contextualism about predicates of personal taste. According to perspectival plurality, the truth value of a sentence containing more than one PPT may depend on more than one perspective. Prima facie, the phenomenon engenders a problem for relativism and can be shaped into an argument in favor of contextualism. O presente artigo parte da problemática: qual a forma de repressão estatal brasileira relativa às fake news? Como provável hipótese de pesquisa tem-se que o Estado brasileiro não tem sido eficiente em dirimir este problema, carecendo de regulamentação específica. O objetivo geral consiste em analisar a atuação do Estado em relação à contenção de fake news. Para tanto, utilizou-se o método de procedimento dedutivo e o de pesquisa bibliográfico. Como conclusão, percebe-se que o Estado brasileiro não consegue alcançar o fenômeno (...) das fake news e a repressão acaba ficando a cargo da iniciativa privada. (shrink)

He had graduated from St Mary’s Seminary in Baltimore and was being ordained as a Roman Catholic priest. The event was attended by many of my family members. Several of the littlest attendees struggled with all the commotion, some were said to be shy, some didn’t want to be crowded, (...) and parents and caregivers did what they could to make it easier on them. Watching those kids trying to cope with a family event, which was different and a bit confusing, brought back a flood of memories of my own childhood. Nothing was simple about my childhood.My life has been “interesting” for sure. As a young child I faced many challenges. Until the age of two and a half I was nonverbal. Even though later I would gain speech, my developmental delays and sensory integration dysfunction issues caused great [End Page 202] difficulty for myself and my parents. I was evaluated by professionals and was diagnosed with an autism spectrum disorder–pervasive developmental disorder not otherwise specified (PDD–NOS) at the age of four.Thoughts of that difficult time filled my head when watching the children at this family function. My uncles, aunts and cousins couldn’t possibly know my struggles in those years. They weren’t present for all the interventions and therapy sessions I endured. Today, they don’t see me as someone different or disabled. I still have some obstacles to overcome in my development but rather than bemoan where I am or where I have been I have chosen to accept myself as I am. Although some may say I have a disability I choose to embrace my abilities and to celebrate them. I’m glad I’ve stayed on a path that has led me to become an independent adult. I am now a national motivational speaker, a Master’s graduate, owner of a non–profit corporation and soon to be an author.But what about this word “disabled”? Since I was six years old I seemed to have been tagged with this word by those around me. They all considered autism as a disability. I didn’t even know I had autism until I was 11. But I was very aware of people defining me as being disabled. It had to be the reason I was being placed in Special Ed classes, for the hours I had to travel to doctors and therapies: occupational therapy, physical therapy, speech therapy. I was being called disabled and I didn’t know why. Of course the signs were there for me that I had a problem. In daycare many things confused and frightened me: loud noises, wind, water, transitions. I cried constantly, a lot more than everyone else. I had terrible tantrums (lying on the floor kicking and screaming) to the confusion and consternation of the adults and caregivers around me. I attended two different daycare centers and was asked to leave both of them. I couldn’t even make the transition from the door of a daycare center to my parent’s car without fighting, screaming and crying uncontrollably.It’s now hard to believe that my difficulty with sensory integration dysfunction, transitions and social interactions lasted for almost 15 years of my life. During those years there were many confusing, frightening and painful episodes for me, my parents and others around us.Like most kids with these types of deficits, we tried to find splinter skills to help me compensate. I have hyper–mobility of the joints making buttoning and fine motor tasks almost impossible. I also have dysgraphia, which makes it difficult for me to hold a pen or pencil to write. Even with therapy I never learned to ride a bicycle. One bright side to the hyper–mobility was being able to learn to type 100 words per minute.My sensitivity to water, wind and loud sounds was extreme. I fought my parents each time they tried to get me into the bathtub. I hated going on the swings because I couldn’t feel my feet on the ground... (shrink)

The overall objective is to explore the question of why our DNA is encoded to actualize an aesthetic experience that is autonomic and cognizant. It is proposed that the aesthetic experience is an adaptation selected by providing relief form the psychophysiological disorders that can arise from life’s burdens. It is further proposed that our aesthetic response to human form is an adaptation brought about by selecting alleles that generate an avoidance of mating with closely related species thus reducing the risk (...) of having less fit offspring, sterile offspring or no offspring. It is noted that with regard to human form apomorphic anatomical traits are attractive and plesiomorphic anatomical traits are unattractive. The term for this attitude has been coined cross species avoidance. The issue were addressed by interfacing philosophical aesthetics with evolutionary principles. (shrink)

The present research study focuses on how the language of instruction has an impact on the mathematical thinking development as a consequence of using a language of instruction different from the students’ mother tongue. In CLIL (Content and Language Integrated Learning) academic content and a foreign language are leant at the same time, a methodology that is widely used in the schools in the present times. It is, therefore, our main aim to study if the language of instruction in second (...) language immersion programs influences the development of the first formal mathematical concepts. More specifically, if the learning of mathematical concepts in the early ages develops in a similar way if it is taught in the students’ mother tongue and is not influenced by the language used for teaching. Or else, if it can influence the development of the first skills only in the students’ general performance or in certain areas. The results of both the analysis of variance and multiple regression confirm how influencing the language of instruction is when mathematical thinking is developed teaching formal contents in a non-coincidence language. The second language is affecting the resolution of daily life problems, being more competent those students in 1st grades whose language of instruction matched with their mother tongue. (shrink)
